First Haul Terms - Acceptance of Terms and Conditions

1. Agreement and Description

First Haul, LLC. ("First Haul," "we," "us" or "our") provides marketing tools, payment processing, scheduling tools, website (www.firsthaul.com), and mobile application (collectively, the "Service"). By using the Service, you agree to these Terms ("EULA"). THIS EULA REQUIRES ARBITRATION FOR DISPUTES RATHER THAN JURY TRIALS OR CLASS ACTIONS AND LIMITS AVAILABLE REMEDIES.

2. Changes to Terms

First Haul may change this EULA at any time but will try to provide notice for material changes. Continued use of the Service after changes constitutes acceptance of revised terms. Your sole remedy for unacceptable changes is to stop using the Service.

3. Key Policies

  • Privacy Policy: Your use of the Service is subject to our Privacy Policy
  • Eligibility: You must be at least 18 years old to use the Service

4. Service Description

The Service connects "Delivery Professionals" with "Customers" seeking delivery services ("Hauls"). First Haul is a platform only and does not provide transportation services.

5. Important Limitations

FIRST HAUL IS NOT A TRANSPORTATION CARRIER OR FREIGHT HAULER. We facilitate connections between Customers and Delivery Professionals but have no responsibility for services provided.

6. Mobile Services

Mobile carrier rates and fees apply when using mobile services. Not all mobile services work with all carriers or devices.

7. Account Registration

  • You must create an account to use the Service
  • You are responsible for maintaining the security of your credentials
  • Report lost/stolen credentials immediately to customerservice@firsthaul.com

8. Customer Rules

  • Requesting Hauls: Provide pickup/destination addresses, item details, and scheduling information
  • Prohibited Items: Includes valuables, documents, animals, and other specified items
  • Delivery Professional Rights: May inspect, refuse, or return items at their discretion
  • Fees: Base fees displayed in the Service include expenses like tolls
  • Payment: Credit card processing with non-refundable fees and cancellation charges
  • Insurance: Maximum claim limited to declared value or $50,000
  • Undeliverable Items: Storage fees of $100/day may apply

9. Intellectual Property

  • License: Service is licensed, not sold, for personal, limited use
  • Content: First Haul Content is protected; User Content ownership remains with you
  • Restrictions: No reproduction, modification, or distribution of First Haul Content

10. User Conduct Restrictions

Users agree not to misuse the Service, interfere with its operation, or violate laws.

11. Dispute Resolution

  • Binding arbitration required for all disputes
  • No class actions permitted
  • Pennsylvania law governs this agreement

12. Liability Limitations

First Haul disclaims warranties and limits liability to $100 maximum. Users release First Haul from responsibility for third-party actions.

13. Additional Terms

  • Termination: First Haul may restrict or terminate service at any time
  • Electronic Communications: You consent to electronic notices
  • Promotions: First Haul Credits have limitations on redemption and use
